The Gist
We (the team at My Salon) run a website, app and online platform for beauty services called MySalon.ie and would love for you to use it. MySalon.ie’s basic service is free for beauty professionals, and clients are charged a deposit (or the full cost of the service, depending on their own choice) when making a booking. Our service is designed to facilitate the connection between clients and beauty professionals and encourage them to find each other through a modern medium. Be responsible in what you post and who you choose to work with. In particular, make sure that the information you provide is accurate and that your client or your beauty professional is legitimate; we cannot do it on your behalf.
If you find a MySalon.ie user that you believe violates these Terms & Conditions, please report them through our Support system.
Terms & Conditions
The following terms and conditions (“Terms”) govern all use of the MySalon.ie website, app and all content, services, and products available at or through the website. Our Services are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, MySalon.ie’s Privacy Policy) and procedures that may be published from time to time by MySalon.ie (collectively, the “Agreement”). You agree that we may automatically upgrade our Services, and these Terms will apply to any upgrades.
Please read this Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to become bound by the Terms of this Agreement. If you do not agree to all the Terms of this Agreement, then you may not access or use any of our Services. If these Terms are considered an offer by MySalon.ie, acceptance is expressly limited to these Terms.
Our Services are not directed to users younger than 18, and access and use of our Services is only offered to users 18 years of age or older. If you are under 18 years old, please do not register to use our Services. Any person who registers as a user or provides their personal information to our Services represents that they are 18 years of age or older.
Use of our Services requires a MySalon.ie account. You agree to provide us with complete and accurate information when you register for an account. You will be solely responsible and liable for any activity that occurs under your username. You are responsible for keeping your password secure.
These terms and conditions of use shall be governed by and construed in accordance with the laws of Ireland, and you hereby agree for the benefit of MySalon.ie, and without prejudice to the right of MySalon.ie to take proceedings in relation to these terms and conditions of use before any other court of competent jurisdiction, that the courts of Ireland shall have jurisdiction to hear and determine any action or proceedings that may arise out of or in connection with these terms and conditions of use, and for such purposes you irrevocably submit to the jurisdiction of such courts.
Limitation of Liability
By using the Website, the App or Service, you agree to MySalon.ie free from liability or responsibility for any damage that might arise out of the transaction between you and this Website, the App or any Beauty Professionals.
Please note that we simply provide the platform that connects users (such as you) with Beauty Professionals and allows them to be introduced. We do not, ourselves, provide any beauty services or other services of the type listed on the Site or App as being provided by Beauty Professionals and any contract for the provision of those services is between you and the relevant Service Provider (and not us). It is up to the relevant Beauty Professional to perform any services you request through MySalon.ie and you agree to comply with any terms of service that apply between you and the relevant Beauty Professional.
We do not employ Beauty Professionals and, unless otherwise specified in these terms of use, we are not responsible for, and make no representations, warranties or guarantees as to, the behaviour, acts or omissions of any Beauty Professionals you engage through MySalon.ie or the app or the quality of the services they provide. If a Beauty Professional you engage through MySalon.ie causes any damage to your property, your person or anyone else in the course of providing services to you, responsibility for such damage will rest with the Beauty Professional (and not with us).
If you have a complaint in relation to the services provided by a Beauty Professional, that complaint must be taken up with the Beauty Professional directly. If you are unable to resolve a dispute with a Beauty Professional or you cannot come to an agreement with a Beauty Professional, please contact us and we will use our reasonable endeavours to try to resolve the dispute.
We also cannot guarantee that any particular Beauty Professional is suitable for your purposes and you use Beauty Professionals at your own risk, although we may remove a Beauty Professional from MySalon.ie on the basis of any feedback you or other users provide in relation to that Beauty Professional if we deem it appropriate, but are under no obligation to do so.
To the fullest extent permitted by applicable law, neither MySalon.ie nor any of its directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with your use of, or your inability to use, the Materials, Software and/or facilities or services offered through the website or app, including, but not limited to, indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, injury or death, even if MySalon.ie has been advised of the possibility of such loss or damages, or such loss or damages were reasonably foreseeable.
Responsibility of Clients
If you make a booking through MySalon, use the MySalon.ie app, or otherwise make (or allow any third party to make) material available (any such material, “Content”), you are entirely responsible for the content of, and any harm resulting from, that Content or your conduct.
You are responsible for the validity and accuracy of the information you provide on the booking. The beauty professionals are not bound to offer their services if your details are inaccurate, and providing incomplete or inaccurate information to them can result in them refusing to work with you.
You are required to verify the legitimacy of the beauty professional you choose to work with. Although professionals providing false information are in violation of these Terms & Conditions, it is your responsibility to protect yourself and your household against illegitimate or malicious contractors.
You are required to discuss all the booking details, including how to prepare for it with your professional before the day and hour of the booking.
If you pay a deposit to secure your booking, you are required to discuss with your beauty professional before the booking day and time and agree on how the balance is to be paid directly to them — either via cash, card, bank transfer, or any other payment method they accept. MySalon.ie is in no way involved and cannot be held responsible for anything related to this payment.
Responsibility of Beauty Professionals
If you register on MySalon.ie as a beauty professional, accept bookings or use our app, or otherwise make (or allow any third party to make) material available (any such material, “Content”), you are entirely responsible for the content of, and any harm resulting from, that Content or your conduct.
You are responsible for the validity and accuracy of the information you provide during the registration process, through your profile, the qualifications that you register under, and at all other interactions with MySalon.ie and its users. You are required to be a qualified beauty professional who is allowed to operate legally in Ireland in order to create a MySalon.ie account.
Registering for or operating a MySalon.ie account without being a qualified beauty professional who is allowed to operate legally in Ireland will result in the immediate termination of your account.
Beauty professionals are paid for their completed bookings in cash or any other means that they agree with their client. You are solely responsible for this income and for declaring it according to your tax obligations. You are required to provide a receipt for the service if the customer requests it.
You are required to complete the agreed service for the amount you agreed on when accepting the booking.
You are required to discuss all the booking details, including how to prepare for it with your client before the day and hour of the booking.
The Booking Deposit
The Booking Deposit secures a client’s booking. The deposit also acts as a service fee for MySalon and is only refundable if certain conditions are met.
Refund Policy for Booking Deposits
The client will receive a refund of their booking deposit only in the following circumstance:
- The client paid a booking deposit through the MySalon.ie platform but their chosen professional did not confirm the booking, and they didn’t accept or be offered a replacement professional (in which case a refund will be automatically processed within 3-5 days of when the service was supposed to take place).
The booking deposit will not be refunded in any other circumstances, including but not limited to:
- The client cancelling the booking after accepting a professional, or after their chosen professional accepted the booking
- The client didn’t provide a correct and complete address, phone number and e-mail and the professional wasn’t able to contact them and/or arrive at their location in time for the booking
- The client didn’t prepare adequately for the booking and the service couldn’t be provided as a result of that
- The client didn’t adequately communicate their exact requirements to their professional before the booking day and time
- The client requested a change or an additional service from their professional and they were refused
- The client is unsatisfied with the service done by the professional they chose or the one they accepted as a replacement for their chosen professional
Web Traffic
We use a third party, Google Analytics. (“Analytics”), to measure MySalon.ie’s audience and usage. By using our service, you agree to assign the traffic relating to using our website to MySalon.ie and authorise us to sign a Traffic Assignment Letter on your behalf for Google Analytics audience measurement reports.
Payments and Refunds
MySalon.ie uses third party services, PayPal and Stripe (“Payment Gateways”) to collect and process payments and refunds. By using our service you agree to their Terms and Conditions and Privacy Policies.
Copyright Infringement and DMCA Policy
As MySalon.ie asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by MySalon.ie violates your copyright, you are encouraged to notify MySalon.ie in accordance with MySalon.ie’s Digital Millennium Copyright Act (“DMCA”) Policy. MySalon.ie will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. MySalon.ie will terminate a visitor’s access to and use of the website if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of MySalon.ie or others. In the case of such termination, MySalon.ie will have no obligation to provide a refund of any amounts previously paid to MySalon.ie.
Intellectual Property
This Agreement does not transfer from MySalon.ie to you any MySalon.ie or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with MySalon.ie. MySalon.ie, the MySalon.ie logo, and all other trademarks, service marks, graphics and logos used in connection with MySalon.ie or our Services, are trademarks or registered trademarks of MySalon.ie or MySalon.ie licensors. Other trademarks, service marks, graphics and logos used in connection with our Services may be the trademarks of other third parties. Your use of our Services grants you no right or license to reproduce or otherwise use any MySalon.ie or third-party trademarks.
Termination.
MySalon.ie may terminate your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your MySalon.ie account (if you have one), you may simply discontinue using our Services. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
By signing up and/or making a booking on MySalon.ie you hereby agree to us forwarding that information to your chosen professional and/or the replacement professional that you accept for your booking.
We do not request (nor encourage you) to submit sensitive data to MySalon.ie (i.e. data relating to racial or ethnic origin, political or religious opinions, membership of a trade union, physical or mental health or condition or sexual life, the commission of any offence or related documentation). If, however, you choose to do so then you consent to our processing this data in the manner set out in this Agreement.
You should be aware that when you disclose personally identifiable information and agree to make that information available to beauty professionals on MySalon.ie (e.g. by making a booking) that the information disclosed in your communication may be used by the recipient of it. Such recipients may use your information (for example they may contact you, arrange a meeting with you, etc.) and such third party activities are beyond our control.
If you have submitted information using MySalon.ie to a client in respect of a particular booking then you understand that we process that information as an agent of the customer. If you have submitted information using MySalon.ie about a booking under the role of client you understand that we process that information and will make it available to your chosen professional and/or the replacement professional that you accept for your booking. We may hold a backup copy of the information that you submit, but only as an intermediary. If you wish to modify or deal with your personal information submitted in respect of a particular booking then you should contact the recipient directly, as they have responsibility for that personal information. As an intermediary, we will comply with the user’s instructions in respect of that personal information. If you wish to understand the user’s data protection or privacy policy with regards to the dealings it has with your personal information then you should contact the user to establish such terms.
